(1)<\/strong> The fol\u00adlowing terms and con\u00addi\u00adtions apply to con\u00adtracts (ser\u00advices and products\/goods) that you con\u00adclude with us as the pro\u00advider (Bier-Events | Adam Hellmann) via the website www.bier-events.de. Unless otherwise agreed, we object to the inclusion of any terms and con\u00addi\u00adtions of your own that you may use. <\/p>\n

(2)<\/strong> A con\u00adsumer within the meaning of the fol\u00adlowing pro\u00advi\u00adsions is any natural person who enters into a legal tran\u00adsaction for pur\u00adposes that cannot pre\u00addo\u00admi\u00adnantly be attri\u00adbuted to either their com\u00admercial or inde\u00adpendent pro\u00adfes\u00adsional activity. (1)<\/strong> The subject matter of the con\u00adtract is the sale of ser\u00advices and products\/goods.<\/p>\n

(2)<\/strong> By merely listing the respective service\/the respective product on our website, we submit to you a binding offer to con\u00adclude a con\u00adtract under the con\u00addi\u00adtions spe\u00adcified in the product description.<\/p>\n

(3)<\/strong> The con\u00adtract is con\u00adcluded via the online shopping cart system as follows: The services\/goods intended for purchase are placed in the \u201cshopping cart.\u201d Via the cor\u00adre\u00adsponding button in the navi\u00adgation bar, you can access the \u201cshopping cart\u201d and make changes there at any time. After calling up the \u201cCheckout\u201d page and entering your per\u00adsonal data as well as the payment and shipping con\u00addi\u00adtions, all order data will be dis\u00adplayed again on the order overview page. (5)<\/strong> The pro\u00adcessing of the order and the trans\u00admission of all infor\u00admation required in con\u00adnection with the con\u00adclusion of the con\u00adtract is carried out by e\u2011mail, partly auto\u00adma\u00adti\u00adcally. (6.1)<\/strong> Rebooking of \u201cLive im Lokal\u201d tickets and Live Tastings to another desired date: \u2022 a flat pro\u00adcessing fee of \u20ac25 applies<\/p>\n

(6.2)<\/strong> Can\u00adcel\u00adlation of \u201cLive im Lokal\u201d tickets and vou\u00adchers: \u2022 Exclusion of right of with\u00addrawal and return rights<\/p>\n

(6.3)<\/strong> Can\u00adcel\u00adlation of Beer Web\u00adinars and Live Tastings: \u2022 Exclusion of right of with\u00addrawal and return rights<\/p>\n

(6.4)<\/strong> Con\u00addi\u00adtions regarding indi\u00advi\u00addually cus\u00adto\u00admized tastings:<\/p>\n

(6.4.1)<\/strong> Changes to the booking \/ adding indi\u00advidual persons as well as extras\/specials: \u2022 Changes to the booking are free of charge up to 14 days before the event \u2022 From 14 days before the event and every further change incurs a flat pro\u00adcessing fee of \u20ac15 \u2022 Can\u00adceling indi\u00advidual persons is only pos\u00adsible up to 24 hours before the event \u2022 Com\u00adplete rebooking of the tasting to another desired date costs a flat fee of \u20ac50 \u2022 Every change must be made in the form of an e\u2011mail<\/p>\n

(6.4.2)<\/strong> Can\u00adcel\u00adlation of the booking: \u2022 Made in the form of an e\u2011mail \u2022 Up to 4 weeks before the event, a can\u00adcel\u00adlation fee of \u20ac100 applies \u2022 From 4 weeks before the event, 50% of the total invoice amount applies as a can\u00adcel\u00adlation fee \u2022 From 48 hours before the event, 75% of the total invoice amount applies as a can\u00adcel\u00adlation fee<\/p>\n

(7)<\/strong> Can\u00adcel\u00adla\u00adtions and changes on our part: It may occa\u00adsio\u00adnally happen that we need to correct some details, errors, or changes. In this context, it may be necessary to cancel or change already con\u00adfirmed tickets. We reserve the right for such cases. <\/p>\n

\u00a7 3 Right of Retention, Retention of Title<\/strong><\/p>\n

(1)<\/strong> You may only exercise a right of retention insofar as it con\u00adcerns claims from the same con\u00adtractual rela\u00adti\u00adonship.<\/p>\n

(2)<\/strong> The goods remain our pro\u00adperty until the purchase price has been paid in full.<\/p>\n

\u00a7 4 War\u00adranty and Gua\u00adrantees<\/strong><\/p>\n

(1)<\/strong> Sta\u00adtutory rights for defects exist.<\/p>\n

(2)<\/strong> When con\u00adsumers purchase used goods, if a defect occurs after one year from the delivery of the goods, claims for defects are excluded. Defects that occur within one year from the delivery of the goods can be asserted within the sta\u00adtutory limi\u00adtation period of two years from the delivery of the goods. For entre\u00adpre\u00adneurs, the limi\u00adtation period for claims for defects for newly manu\u00adfac\u00adtured items is one year from the transfer of risk. The sale of used goods is made with the exclusion of any war\u00adranty. The sta\u00adtutory limi\u00adtation periods for the right of recourse under \u00a7 445a BGB remain unaf\u00adfected. With respect to entre\u00adpre\u00adneurs, only our own state\u00adments and the manu\u00adfac\u00adtu\u00adrer\u2019s product descrip\u00adtions incor\u00adpo\u00adrated into the con\u00adtract shall be deemed an agreement on the quality of the goods; we assume no lia\u00adbility for public state\u00adments by the manu\u00adfac\u00adturer or other adver\u00adtising state\u00adments. If the deli\u00advered item is defective, we shall initially provide war\u00adranty to entre\u00adpre\u00adneurs at our dis\u00adcretion by reme\u00addying the defect (sub\u00adse\u00adquent impro\u00advement) or by deli\u00advering a defect-free item (repla\u00adcement delivery). The afo\u00adre\u00admen\u00adtioned limi\u00adta\u00adtions and shor\u00adtening of periods do not apply to claims for damages caused by us, our legal repre\u00adsen\u00adta\u00adtives, or vica\u00adrious agents: \u2022 in case of injury to life, body, or health \u2022 in case of inten\u00adtional or grossly negligent breach of duty as well as fraud \u2022 in case of breach of material con\u00adtractual obli\u00adga\u00adtions whose ful\u00adfillment enables the proper exe\u00adcution of the con\u00adtract in the first place and on whose com\u00adpliance the con\u00adtractual partner may regu\u00adlarly rely (car\u00addinal obli\u00adga\u00adtions) \u2022 within the scope of a war\u00adranty promise, insofar as agreed \u2022 insofar as the scope of the Product Lia\u00adbility Act is opened. Infor\u00admation on any addi\u00adtional war\u00adranties that may apply and their exact con\u00addi\u00adtions can be found with the product and on special infor\u00admation pages in the online shop. <\/p>\n

(3)<\/strong> As a con\u00adsumer, you are requested to check the goods imme\u00addiately upon delivery for com\u00adple\u00adteness, obvious defects, and transport damage and to notify us and the carrier of any com\u00adplaints as soon as pos\u00adsible. Failure to do so will not affect your sta\u00adtutory war\u00adranty claims. <\/p>\n

\u00a7 5 Choice of Law, Place of Per\u00adfor\u00admance, Juris\u00addiction<\/strong><\/p>\n

(1)<\/strong> German law applies. For con\u00adsumers, this choice of law applies only insofar as it does not deprive them of the pro\u00adtection afforded by man\u00addatory pro\u00advi\u00adsions of the law of the state of their habitual resi\u00addence (favora\u00adbility prin\u00adciple). <\/p>\n

(2)<\/strong> The place of per\u00adfor\u00admance for all ser\u00advices arising from the business rela\u00adti\u00adonships existing with us, as well as the place of juris\u00addiction, is our regis\u00adtered office, pro\u00advided you are not a con\u00adsumer but a mer\u00adchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general place of juris\u00addiction in Germany or the EU, or if your place of resi\u00addence or habitual abode is not known at the time the action is brought. This does not affect the aut\u00adho\u00adrization to bring the action before the court at another sta\u00adtutory place of juris\u00addiction. <\/p>\n

\u00a7 6 Pro\u00adtection of Minors<\/strong><\/p>\n

(1)<\/strong> In the sale of goods subject to the Youth Pro\u00adtection Act, we only enter into con\u00adtractual rela\u00adti\u00adonships with cus\u00adtomers who have reached the legally pre\u00adscribed minimum age. Existing age rest\u00adric\u00adtions are indi\u00adcated in the respective product description. <\/p>\n

(2)<\/strong> By sub\u00admitting your order, you confirm that you have reached the legally pre\u00adscribed minimum age and that your details regarding your name and address are correct. You are obliged to ensure that only you yourself or persons aut\u00adho\u00adrized by you to receive the delivery who have reached the legally pre\u00adscribed minimum age accept the goods. <\/p>\n

(3)<\/strong> Insofar as we are obliged by sta\u00adtutory pro\u00advi\u00adsions to carry out an age veri\u00adfi\u00adcation, we ins\u00adtruct the logi\u00adstics service pro\u00advider com\u00admis\u00adsioned with the delivery to hand over the delivery only to persons who have reached the legally pre\u00adscribed minimum age and, in case of doubt, to request to see the ID of the person accepting the goods for age veri\u00adfi\u00adcation.<\/p>\n

(4)<\/strong> Insofar as we indicate in the respective product description that you must have com\u00adpleted your 18th year of life to purchase the goods, beyond the legally pre\u00adscribed minimum age, the pre\u00adceding para\u00adgraphs 1\u20133 shall apply with the proviso that adulthood must exist instead of the legally pre\u00adscribed minimum age.<\/p>\n

\u00a7 7 Third-Party Ser\u00advices<\/strong><\/p>\n

(1) Service pro\u00adviders or service com\u00adpanies are com\u00adpanies in the ter\u00adtiary sector and have a business form through which one or more ser\u00advices are pro\u00advided. Con\u00adtractual devia\u00adtions and changes between Bier-Events and the third-party service pro\u00advider must be con\u00adtrac\u00adtually agreed in writing in a con\u00adtract spe\u00adcific to the order. A sub\u00adse\u00adquent uni\u00adla\u00adteral change to the AGB con\u00adsti\u00adtutes an imper\u00admis\u00adsible con\u00adtract amendment and is void. Con\u00adtract amend\u00adments as well as changes to the AGB can only be made with the written consent of Bier-Events. <\/p>\n
